May 10, 2008 - Board Director Election

Q: What are the MUD Directors' salaries?

A: MUD Directors do not get salaries. Texas State law only allows MUD Directors to receive service fees of a maximum of $200 per day for which MUD business is conducted and an annual maximum of $7200. However, Anderson Mill M.U.D. directors have never chosen to receive the maximum amounts - their daily fee is only $150 and only for days on which posted meetings are called and attended by the directors. In 2007, the fees paid to directors ranged from $1950 to $2400 ANNUALLY (page FS15 of Audit, pg. 32 of PDF), one third or less than that allowed by law and far less than fees paid to directors at other area MUD (and yes- federal taxes are withheld from them). Our directors estimate that they are doing MUD business 30-40 hours per month, this works out to around minimum wage or less per hour.

Q: How much interest revenue did the MUD earn from invested funds in 2007? And how much can the Limited District expect to earn from the approximately $10,000,000 fund it will have?

A: The 2007 Approved Audit Report for Fiscal year ending September 30, 2007 shows on page TSI-8 (pg. 43 of the pdf file) that the MUD earned an ACTUAL $509,874 on all of it's accounts. The Limited District would expect to earn 3% to 3.5% (depending on current rates), which would be $300,000 to $350,000 on an account of approximately $10,000,000. This revenue is expected to be part of the funds used to operate the Limited District.

Q: How many positions are being filled in the upcoming Directors election?

A: Three. Place 1 - currently held by John Kiracofe, Place 2 - currently held by Cindy Ottenbacher, and Place 3 - currently held by Fred Morgan

Q: If I am interested in running for the Board, how do I go about applying for candidacy?

A: To be a candidate, you must first complete an application form and sign it before a notary public. The application forms must be completed and received at the M.U.D. office or by the District’s attorneys, Winstead, P.C. 401 Congress Ave., Suite 2100, Austin, Texas 78701, Attention: Jennifer Waits, no later than 5:00 p.m. on March 10, 2008.

Q: Where can I obtain an application to apply for a place on the ballot?

A: Forms will be available from the District's Administrative office at 11500 El Salido Parkway, Austin, TX 78750; from the District’s attorneys, who can be reached at (512) 370-2832; and on this web site.

Q: Who is eligible to be a Director of the District?

A: To be eligible to serve as a Director for the District, you must be over 18 years of age, a United States citizen, a Texas resident for at least one year, and an owner of property subject to taxation in the District or a qualified voter within the District, who has not been determined mentally incompetent or convicted of a felony. The Water Code also prohibits other persons from serving such as developers of property in the District and persons related to other Board members, developers or District consultants.

Q: Can I apply to be a Director if I already serve on another MUD Board?

A: No. If you hold another elective office, you will be ineligible to serve on the Board. If you hold a position that you feel will disqualify you from service on the Board, you may want to contact the District’s attorney, Winstead, P.C. 401 Congress Ave., Suite 2100, Austin, Texas 78701, Attention: Jennifer Waits (email at:
jwaits@winstead.com) to obtain a complete answer on your qualifications.

Q: What will be the term of office for elected Directors?

A: Four years.

Q: What will be the meeting attendance requirements for an elected Director and how much time is involved in fulfilling the duties of a Director?

A: The Board has a regular meetings every month. In between meetings, Board members serve on committees requiring committee meetings and interaction with the Managers for the District and its consultants. The amount of time invested by each Director varies somewhat, but you will be expected to serve on various committees and attend the regular Board meeting each month.

Q: Does every candidate need to file campaign election finance forms?

A: Yes. The Attorney for the District will assist candidates in making sure that the necessary forms are available to them with instructions for completion of those forms. You will be responsible for completing the forms and filing them on time. Also, prior to receiving or expending any campaign funds, you will need to file the necessary paperwork as required by State Law. If you intend to receive or expend campaign funds, you should contact the District’s attorneys, Winstead, P.C. 401 Congress Ave., Suite 2100, Austin, Texas 78701, Attention: Jennifer Waits (email at:
jwaits@winstead.com) prior to doing so, so that you can file the necessary forms in compliance with State Law.

Q: When will early voting begin for the May 10, 2008 election?

A: April 28, 2008.

 Questions & Answers on Qualifications Needed to Run for Election

Section 54.102 of the Texas Water Code requires that to be qualified to serve as a Director of the District, a person shall be at least 18 years old, a resident citizen of the State of Texas, and either own land subject to taxation in the District or be a qualified voter within the District.

Section 49.052 of the Texas Water Code provides that a person is disqualified from serving as a Director of the District as provided therein. Chapter 573, Texas Government Code, the nepotism law, applies to Directors of the District.

If a person wishes to apply for a place on the ballot for the upcoming May 10, 2008 Directors election, he or she must complete the application form before a notary public and return the completed form to the District’s attorneys, Winstead, P.C., 401 Congress Ave., Suite 2100, Austin, Texas 78701, Attention: Jennifer Waits, or to the District's office, 11500 El Salido Parkway, Austin, TX 78750,  no later than 5:00 p.m. on March 10, 2008.

Such forms will be available at the District's office, on the District’s website and from the District's attorney, phone: 512-370-2823. Detailed information on local elections, forms needed, instructions, and political advertising guides are available on the Texas Ethics Commission web site.

Applicants should review Section 49.052 of the Texas Water Code, Chapter 573 of the Texas Government Code, and Section 54.102 of the Texas Water Code, copies of which will be provided with each application form and on the District’s website.

Three Director Places on the Board are up for election this year. Each Place is for a full four-year term. The Places up for election are: Place One held by John Kiracofe, Place Two held by Cindy Ottenbacher, and Place Three held by Fred Morgan.

Under Title 15 of the Election Code, candidates running for an office of a local political subdivision must file campaign contribution and expenditure reports with the secretary of the governing body. These forms for such filings are available on this web site.

Early voting will begin on April 28, 2008.
